TERMS AND CONDITIONS OF USE 　 1) Acceptance and Confirmation of User’s Terms of Use Users must totally agree to all terms and conditions of use herein. 2) Brief Introduction of Service The Whoyo Games Portal www.whoyo.com.my, owned by Netelusion Games (M) Sdn Bhd, herewith collectively known as “WHOYO” uses one’s own Operating System that is connected to the Internet. Users are responsible for: · Providing all equipment necessary to surf the Internet, Network Access and other expenses. · All Telephone, Broadband and other expenses WHOYO shall not disclose user’s personal and confidential information subject to the following exceptions: · User authorizes WHOYO to do so. · Relevant Government bodies or Legal Entities require WHOYO to do so. 3) Amendments to Terms of Service WHOYO reserves the right to revise the Terms & Conditions of this Agreement at any time. WHOYO shall post such amendments on its website. Users can choose to terminate using our service after such posting. Continued usage shall deem acceptance of these Amendments. WHOYO also reserves the right to revise or terminate providing services to any user at any time and will not be responsible for any consequences arising from such action. 4) User’s Confidentiality It is the basic policy of WHOYO to respect User’s privacy and confidentiality. All users must fill in accurate and correct information in order to enjoy the best services WHOYO has to offer. WHOYO however, will not disclose or reveal such information without User’s authorization unless under legal requirement to do. The above is subject to the compliance of the following conditions by the User: · Observe and comply with legal provisions and requirements of WHOYO. · Maintain and protect the Trademark ownerships within WHOYO. · Adhere to relevant requests by WHOYO. 5) Member’s Username, Password and Security Once a user succeeds in registration, he/she shall become a legal member of WHOYO and will receive a username and password. Users shall be responsible for the safe and secured usage of his account. Users shall be fully responsible for all activities and incidents arising from his/her account, including trading of account names and virtual items. Users can change passwords by following the instructions at any time.Should users find that their account has been tampered with or should there be any security breach, users are to notify WHOYO immediately. 6) User’s Own Risk Users utilize the services and products of WHOYO solely at their own risk. WHOYO shall not be responsible for any interruption in services, any errors made, security breaches or any other problems or issues arising from using WHOYO. WHOYO shall also not be responsible for any losses whatsoever incurred whilst using WHOYO. Should users find WHOYO services or products not to their satisfaction, they can choose to terminate their account with us provided always that NO REFUNDS of whatever nature shall be made. 7) Liability Exemption WHOYO shall not be responsible for any untoward direct, indirect or accidental incidents arising using WHOYO. These include any interruption of services, losses arising from trading between users in WHOYO of whatever nature, eg – including but not limited to virtual items, user accounts. WHOYO shall also not be responsible for any illegal or harmful trades between users. WHOYO shall also not be responsible for hacker attacks, legal offences committed by users via using WHOYO, password thefts, memory status loss of users. Notwithstanding this, WHOYO will take care and caution in preventing memory loss (enabling users to keep their status and game level) but shall not be held responsible should this occur. 8) User Ethics & Behaviour Users shall use WHOYO always in good spirit and behaviour in line with that of the Gaming Community. Users shall not use language of a vulgar nature or profanities of any kind and shall play the games fairly and considerately. Should any user fail to abide by these ethics or perform any behaviour deemed unsuitable, solely upon WHOYO’s judgement and decision, WHOYO shall reserve the right to terminate the User’s account without any notice given whatsoever. 9) Users’ Responsibilities Users are wholly responsible for all their transactions and data/information transacted via the Internet. Users shall ensure that all content transmitted are of a legal nature according to the Laws of Malaysia and shall be held solely responsible should they view, visit or utilize the services of any website not in accordance with the Laws of Malaysia. Users shall also ensure that all their input to WHOYO are suitable for the Gaming Community and in accordance with the Laws of Malaysia.Users shall: · Ensure all materials transmitted are in accordance with the Laws of Malaysia. · Not to use the Network Services for any illegal purposes. · Not to interfere, corrupt or confuse the Network Services. · Observe all protocols, regulations and procedures of the Network Services including but not limited to strengthening the Internet’s Information Service Management, electronic regulation of announcements over the Internet and strengthening Culture Market Management according to the Ministry of Culture. · Observe all Product User Agreements announced at WHOYO.Users must promise not to transmit or distribute any illegal, vulgar, obscene or pornographic materials. Users must not abuse, slander or harass other users. Users must not transmit materials that instigate others to commit criminal offences or material that could cause unfavourable domestic conditions. Users must also not transmit materials that threaten National Security. Users must not enter other users’ computer systems without their permission. Any user caught contravening any of the above shall have their WHOYO account terminated without prior notice and no refunds shall be given. Such users shall also face any criminal action solely on their own and bear all legal liabilities and losses incurred. 10) Legal Costs All users shall bear all legal costs incurred should their cases end up in litigation matters of the Court. 11) Termination Users can choose to terminate their account with WHOYO at any time but strictly with no refund given. Likewise, WHOYO can terminate any user account subject to the above conditions and shall not be held responsible for any losses or damages incurred, if any, by the user. Subsequent to such termination, WHOYO shall not be under any obligation whatsoever to provide or convey any information to the user or any third party. 12) Notices All Notices shall deemed to be delivered, read and understood upon the following methods: · Email to users. · Announcements via website. · Amendments to Terms of Service. 13) Advertisements Users subscribing, participating, purchasing goods, services through advertisements placed in WHOYO shall do so solely at their own risks. All costs incurred in above shall solely be borne by the User and shall not be the responsibility of WHOYO in any way. 14) Copyright · All materials, contents, pictures, graphics, software, sound, video, charts, advertisements in WHOYO and its emails have copyright and trademark protection together with label and other property ownership law. · Any persons wanting to use or reprint any of the above require the authorization of the respective copyright owner and text author. · The strictest legal action shall be taken against persons violating any of the above. 15) Laws of Malaysia The above terms and conditions shall be governed and interpreted under the Laws of Malaysia.
